My son is 2 1/2 and surrounded by a backless booster form?

My son is 2 1/2 and wont be 3 until march 18th and his father and aunt have him in a backless booster form, can i turn them in and if so what will transpire? last time i checked they have to be in a carseat until age 4 and consequently a booster seat until age 8

It depends on where on earth you live. However a child can be in a booster form w/ back at 30 lbs. and should be surrounded by a seat until they are 7 or 8.
