I was driving on a 2way street & guy gets in the opposing traffic lane to cut me off. That kind of upset me, so i did the same thing to him (I know, bad choice)... Only thing is when I tried to cut him off he blocked me and deliberately ran his car into mine. My car got a huge dent on the side... his car had NO damage whatsoever. He gets out the car... yells, cusses, etc... Then he gets back in his car and leaves. I see him later at the mall. And he's asking for my drivers license and insurance. So Im like ok Ill EXCHANGE information, but Im not giving up anything unless I get yours too. He wont give me his. Then he hops on his phone and says hes calling the cops. I say fine, Ill wait for them to get here. 15 secs laters hes back off the phone yelling and cussing. I went back to my car, waited for the police and they never came.So I called my insurance & the police just so they could notate this so he cant say it was a hit & run in case he does call the police.Am I handling this right?
Answer:
Your doing the right thing. If he confronts you again, tell him your insurance company is handling the incident and he should contact them if he has a problem. Anything else he does to you would be considered harassment.
Always get a police report at the time of the incident.
Don't be afraid to contact your insurance agent. Insurance is there for a reason, use it. Especially in situations like this.
Good luck Jesse!
I agree get a police report,, let your agent take care of this
He is guilty of a crime for leaving the scene of the accident regardless of who is at fault. He also can't refuse to give you his information. I see very little chance of him being able to win a legal decision because he left the scene without reporting the accident. Whether you want to file a claim or not for the damage to your car is up to you but I would make it clear to the police and your insurance that he left the scene of the accident without exchanging information. He can't decide to file a claim later because he ran into you at the mall.
This is a clear case of road rage and you should report him for that. He needs and wants punishment. Give it to him.
You did everything absolutely right. Just file a claim through your insurance.. tell them the truth... andthey will investigate and handle this jerk for you.. afterall, this is what you pay them for.
If he does this again, remind him that he was the one who left the accident scene and refusal to exchange info is a misdemeanor in most states.
