I was in a car accicdent. A guy ran a red light, i swerved to miss him and I hit a wall. I got cut up, a bunch of bruises, really sore back, My hand had a big knot on it and hurt anytime I put pressure on it, but x ray came back OK, and a concussion. I was taken in the ambulance. I missed a week of work.My hand just now started feeling better...almost 2 months later. As for the concussion I feel like a have short term memory problems now. I have a hard time remembering stuff now. Sometimes a txt someone on my phone and then 5 minutes later I cant figure out who i txt.
I dont expect to get rich at all but I was wondering what would be reasonable. I dont wanna get lowballed by his insurance company, which happens to also be my insurance company.
thanks in advance
Answer:
It really depends on a LOT of variables. We have your side of the story, but there's always two sides (at least). So it depends on the details of the accident, the extent of your injuries, and where you live. Differant countries have differant laws dealing with this. Differant -states- have differant laws about this. Go talk to a lawyer.
Go to a lawyer. He/She can tell you. Figures on here would be uneducated guesses.
1 trillion
How will you remember asking this question?
It's really difficult to give an amount, so many factors come into play, some more important, than others. Things like your age, do you have a permanent disability caused by the wreck, do you have medical proof of that, if not, why don't you, if you do, what kind of time frame does the medical community feel you will be unable to work, or will suffer permanent damage. Are they willing to step forward, on your behalf in a trial? Your work history comes into play, can you be rehabed? Do you plan on seeing a doctor regarding the short term memory? That's the kind of information you need, to show why you deserve a financial settlement. Good luck.
You really have to stop and think.I've been told it can take up to 5 years before your pain gets better or worse! Also if you have to miss work in the future. Alot of companys don't want to pay or they want you to take what ever they offer you. And if you take what they offer you and you have more problems later then you have to pay for medical visits not the company. And your insurance company should be doing everything for you.You pay them to do their job.
There is no standard formula for figuring out what is fair. Each case is evaluated on its own merits. If someone tells you "Three times your medical bills" thank him, but then ignore his advice. It depends on your diagnosis and prognosis, so make sure you have your doctor's final report. Your best source of information will be your insurance agent. I wish you well.
This is going to be lengthy, but here goes...
First, do NOT rush to get an attorney. They will take an average of 30% of your settlement so, unless you're getting a bundle, it's not worth it.
Next, let your insurance company help you...has the other company accepted responsibility for the accident? Was the other driver ticketed? Were there any witnesses? Your insurance company will have or can get all these answers for you.
You probably have already done most of this, but still general information for others.
At some point you'll have to talk to the other company...keep in mind that most large companies have many different people that you might talk to...the days of having one adjuster handle your claim may be over.
Don't discuss settlements with them until they have agreed to handle all your reasonable medical bills 100%. Be sure to tell your doctor(s) everything so you're sure you can recover, because once you settle, you can not go back for more money.
Finally, when you begin to talk settlement, save pain and suffering for last...start with time off work, replacement of clothing that may have been destroyed, etc. Once you are satisfied with that, put a figure in your mind for pain and suffering. Don't give it to the company. Wait for their offer...it's ALWAYS low...be sure to be offended by it--don't be shy.
Tell them you've tried to act in good faith by not hiring an attorney, but their offer is offending. You can often get 3 or more times what they are offering depending on your condition and the severity of the accident. After you've refused their offer, they're going to ask you for a figure...don't be shy, because they asked and should be ready for your answer. They will probably refuse and counter an offer.
Go from there. Again,do not settle until you are very sure you can recover, because you can not go back for more later.
Good luck.
