I just got into a car accident yesterday. This is the story of what has happened... I was at the light on red.. waiting for it to turn green.. as soon as it turned green i proceeded forward with the other traffic. Out of nowhere in the middle of the road I see a car right infront of me and I crash into its side. I get out of the car and the guy says to me I turned on a yellow (of coarse he wouldnt say red). We wait for the cop car to come and then the guys father goes over and talks to the cop (FDNY -- Father). The cop comes out of the car and says blahblah I've seen a million accidents like this and it seems like it is your fault etc. Who knows what the guy's father said to the cop before hand. I told the cop I was sitting at the light (very nasty cop btw), and I proceeded forward with the traffic and he didn't go into me. What i'm not sure is if he turned on a yellow/ or just turned red arrow) or if he tried to jump infront of me on a green. The cop wrote out the report and now i'm

you may not want to hear this but it sounds like you may be at fault even if the other driver was a red light runner and the cop was a jerk
if he was in the intersection and you proceeded into the intersection and didnt allow him to complete the turn you might be considered at fault. especially if there are not witnesses to contradict whatever his dad might have said. plus his father was not there when the accident occured. you definetely need a copy of the report. Contact your insurance company and make a claim ASAP before they are notified via the police report. Hopefully this will help you but the damages to each vehicle will be the bearer of truth.
i understand how you feel. i was involved in an accident about 4 years ago where i was not at fault. the at fault driver made a turn (left) and when asked why he said he did it because the person in front of him did it event hough they had a red light. his ins co was a nightmare and refused to honor my claim for reimbursement of my damages. i tried to talk to his parents to ask them to have thier insurance co cover my costs. the insurance rep called me and told me to stop harassing their customer. i told her that i contacted her client to avoid going to court. she said they were not going to pay-i took them to court and won all of the money including my court costs, which their insurance co ended up paying.
the kicker-i hadnt had the car for week when this happened and the other not at fault driver had picked up his car (which was totaled) the same day i got mine!

ouch this sounds so sticky, hopefully you will have a good adjuster who will be able to tell from the damage to your vehicle that your story is true. your insurance co adjuster has the only important opinion.
You possibly need a witness/es to change the tide of things. But most witness would not speak up because they don't want to get involved. If you had a passenger by your side, it's possible you can use them as witness. If not, you could possibly take them to court and sort things out. Just hope you win ;)
It's your duty to make sure the intersection is clear before you enter it. He may have been wrong but they look at who had the last chance to avoid an accident and that would be you for not entering a clear intersection. Sorry. It stinks but that's the way it is.
